A. Jain Store Return Policy

If you purchased your A. Jain jewelry, in-store, through one of our authorized retail partners, please speak to them to discuss their independent return policies. In-store return policies are subject to the independent return policies set forth by our trusted and valued A. Jain Retail Partners thus all in-store returns and exchange policies vary from partner to partner. Please be sure to check with your trusted A. Jain Retail Partner for their specific policies before making any in-store purchases.

A. Jain Store Out of Stock Policy

We at A. Jain are inspired every day and thankful for everything the earth provides to us. Therefore, we take the upmost care to practice sustainability and care for the environment, even at the most microeconomic levels.

Due to our strict policies on sustainability we have made a conscious choice to maintain low inventory, thus eliminating waste, reducing over-production and keeping our carbon footprints as low as possible. We keep our inventory of available products between zero and the minimal amount necessary, fluctuating with sales demand.

All the A. Jain products are made-to-order, which means all of the gemstones are sourced and manufactured (cut and polished) when required, our metals are refined and cast when required, and our jewelry is thus completely made-to-order; eliminating waste and reducing our production carbon footprint as much as capable.

If the item is identified as “Out of Stock,” please email us at info@a-jain.com about further details and whether we can special order the item for you by specially sourcing the raw materials needed for your order. If this is the case, we will ship it to you as soon as we get it. Most items ship within two weeks.

Just because the item you ordered is NOT identified as out-of-stock does not necessarily mean that it will be in-stock at the moment you order it. We will notify you if the item you ordered is out-of-stock. We first try to reply via email and give you three days to reply. If we have not heard from you we will then try to call you at the numbers you provide with your order. Be sure to give us your current email address and phone number.

Some items are listed for sale on our web site that have not been released from the manufacturer yet. We place these items on the web site so that consumers may pre-order the items. Pre-orders are reserved with payment up front on a first come, first served basis. You may also request to be placed on a “notify list” and we will let you know when products are in-stock and available for delivery. Be advised that prepaid orders always get priority for delivery.

Many out-of-stock items are excellent products and are available for purchase, but we do not always stock these items in inventory. We will be happy to special order these items for you in a timely fashion. Again, most items ship within two weeks.

All items offered for sale through the Website are subject to availability, and we reserve the right to impose quantity limits on any order, reject all or any part of an order, and discontinue offering items without prior notice, even if you have already placed an order for an item. All prices are shown in U.S. dollars and applicable Taxes (as defined below) and other charges, if any, are additional. All prices are subject to change without notice.

In the event that an item you are interested in purchasing is not listed on the Website or is listed as “Contact Us” on the Website, it may not be available for ordering from our online inventory, but may be available elsewhere through our extensive network of authorized A. b.  Taxes

You are responsible for any sales, use, duty, or other governmental taxes or fees (“Taxes”) due with respect to your purchase of items through the Website. We will present an estimate of Taxes to be collected at checkout, except where we have clearly stated in writing that a price includes Taxes. The actual taxes charged may be adjusted from the amount shown at checkout. Several factors may cause this adjustment, such as variances between processor programs and changes in rates of Taxes.

c.  Payments

By providing a credit card or other payment method accepted by us, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable Taxes and other charges). If the payment method cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or cancelled. You must resolve any problem we encounter in order to proceed with your order. In the event you would like to change or update payment information associated with your account on the Website, you can contact our customer care team to assist and update your account with new payment information. If any of the items in your order are unavailable, we will charge only the prices, Taxes and other applicable charges associated with the items that are included in the shipment.

d.  Shipping and Handling

You agree to pay any shipping and handling charges shown at the time you make a purchase. We reserve the right to increase, decrease, add or eliminate shipping and handling charges from time to time; however, we will provide notice of the changes applicable to you before you make your purchase. Any delivery dates or times shown as part of the checkout process are estimates only and are not guaranteed. Unless we state otherwise, risk of loss or damage to an item passes to you upon delivery of the item to your specified delivery location. All shipments from A. Jain are shipped Insured via FedEx 2nd Day (where available) unless a rush is requested. The cost of the upgraded shipping service is to be paid always by the customer prior to the order shipment.

e.  Returns, Exchanges, Cancellations, and Refunds

Please note: Due to evolving global circumstances, our service department may experience some delays with refund processing.

To return an item you purchased through the website, please contact us at sales@a-jain.com or contact us at (917) 459-0124. Please provide us the original order number, packaging slip, or receipt number enclosed with your order and indicate the reason(s) for the return and whether you wish to exchange the item or to receive a refund or merchandise credit in the amount you paid for the item pursuant to these Terms of Sale.

You must enclose the completed return section of the original packing slip in the package you send to us with the item you are returning. You may ship your return to us prepaid and insured, to us at: A. Jain International Enterprises LLC, 20 West 47th Street, Suite 1402, New York, NY 10036. Please allow 2-3 weeks for the processing of your return and a member of the A. Jain team contact you with further steps.

Please note that any item purchased on the A. Jain website may additionally be returned at your nearest authorized A. Jain retail partner (“retailer”) and must be accompanied with the original sales receipt issued by A. Jain. The nearest authorized A. Jain retailer is defined based on the closest authorized retail partner within 50 miles of your delivery zip code. Please note that all refunds will be issued to the original form of payment, except that cash purchases will be refunded by a company check from A. Jain International Enterprises, LLC. All items returned to us must be unaltered, unworn and in saleable condition, based upon inspection by a trained A. Jain Quality Control specialist as defined as (i) a full-time A. Jain employee, or (ii) employee of an authorized A. Jain retailer/retail partner. In addition, all returned items must include the original packaging in new condition and all associated tags. Please note that used merchandise is not eligible for return or exchange unless such items are defective as deemed by A. Jain Quality Control specialists or A. Jain authorized representatives. All alternations and/or personalizations of new and existing designs (including ring sizing), personalized and/or custom designs, close-outs, special orders, are final sale and not eligible for return or exchange. Special orders, alterations, personalizations include any jewelry, gemstone or watch that has to be ordered to accommodate the customer’s request for an alternative style, size, metal or color that is not available in stock. Some exclusions may apply.

f. Standard Online Return Policy

We want you to be completely happy with the items you order from us. If for any reason you are not satisfied with an item you purchase through the Website, you may return such item (accompanied by your sales receipt) within 14 days of the date on which the item was delivered to you and elect to: (i) receive a full refund in the amount you paid for the item, (ii) exchange the item for another item available for purchase through the Website, or (iii) receive a merchandise credit in the amount you paid for the item that may be applied to your purchase of another item through the Website. If you return an item to us after such 14-day return period, but between 15 and 30 days of the date on which the item was delivered to you, you may still return the item and elect either to (i) exchange the item for another item available for purchase through the www.a-jain.com website, or (ii) to receive a merchandise credit in the amount you paid for the item that may be applied to your purchase of another item through the website at a later date.

All refunds will be issued to the original form of payment with the exception of cash purchases, which will be refunded by company check. All returns must be unaltered, unworn and in saleable condition in order to receive a full refund and/or merchandise credit. Any returns that are deemed unable to be accepted for a refund, will be shipped back to you. Please allow 2-3 weeks for return and refund processing.

g. Order Cancellation Policy

Please submit any cancellation via email to info@a-jain.com within our allocated 2 business days only to forgo order cancellation fees and/or restocking fees. Allocated 2-Day (48 hour) order cancellation window starts at the time we receive your order for processing and ends 2 days (48 hours) later.

Email cancellations must contain the following: First name, last name, email address, order number, items you’d like removed from your order. This information must be identical to the information originally submitted on your order. Please provide contact information (phone and email) so that we may contact you if we have questions in regards to canceling your order.

Every effort will be made to accommodate the cancellation of your order, providing your order has not missed our 2-day order cancellation window. In the event that a cancellation was submitted (via email or phone) and was past the allocated order cancellation time frame, we will try to accommodate you with your order cancellation, however you may be subject to restocking fees and/or additional cancellation fees.

h. Restocking

Special Orders Returns, Cancellations, and Restocking

Due to the sustainability and best business policies set forth by A. Jain for A. Jain and our trusted vendors, manufacturers, and other parties involved with production, any and all products ordered directly from our website with alterations, customizations, personalizations are considered “special-order” and/or “made-to-order” and any returns and/or cancellations may be subject to a restocking fee of up to 30% of the original purchase price of the item at the discretion of A. Jain. Taxes will also be recalculated and refunded based on the restocking fee.

Restocking fees are voided if the items delivered, are returned due to manufacturing defects (i.e. chips, dents, scratches, sizing discrepancies due to manufacturing error, etc.). Such manufacturing defects should be reported to us within 24 hours of delivery of order, otherwise voiding the return and/or restocking fee will be at the discretion of A. Jain on a case-by-case basis.

A. Jain reserves the right to replace and/or repair said manufacturing defects free of charge to avoid restocking fees for purchaser. If you opt out of free repair or replacement services to rectify the observed manufacturing defect, then refunds, return, and/or exchange policies apply from date return shipment was received by you. i. Repairs and Service

Please note: Due to evolving global circumstances our service center may experience delays with processing repairs and service requests.

We want you to enjoy your A. Jain designs for years to come. Should your merchandise ever need servicing, you can entrust our specialists with repairing it to preserve its beauty and longevity. Simply bring your item to the authorized A. Jain retail partner it was purchased from or contact us at sales@a-jain.com to receive instructions on how to send the item to our service center.

Upon receipt, our team of Quality Control specialists and master jewelers will evaluate the item. The evaluation may take 1-5 business days after which, we will contact you to discuss any service fees. We take “time owned” as well as “condition received” into consideration when evaluating a piece.

We will clean your jewelry (ultrasonic and steam) and check the setting free of charge. We recommend this be done every 6 months. Not responsible for the loss of stones due to worn prongs and settings when cleaning.

Liability for any damage or loss of items left in store shall be limited to actual cost to repair or replace the item(s). A. Jain shall not be held responsible for the following: (a) identification or condition of jewelry at time of receipt; (b) altered, treated, or enhanced diamonds or colored stones; (c) pieces that are unmarked or whose metal content is stamped incorrectly. Not responsible for items left beyond 120 days.

j. Terms

i.  Price Adjustments

If the price of an item you purchase through the website is reduced due to such item becoming a permanent sale item within 10 days of the date on which you purchased the item, you may contact us to receive a one-time (single order) refund or price adjustment for the item purchased. Such refund or price adjustment applies only to items that become permanent sale items and excludes temporary special promotion items. ii.  Errors

We attempt to be as accurate as possible and to eliminate errors on the website; however, we do not represent or warrant that the descriptions, pricing or other information on the website is accurate, complete, reliable, current or error-free. In the event of an error, we reserve the right to correct such error and revise your order accordingly (which includes charging the correct price) or to cancel your order and refund any amount charged. Please note that:

If the correct price of an item you purchase through the website is higher than our stated price, we will, at our discretion, contact you for instructions before shipping. If we are unable to contact you after 15 days, we will cancel your order and notify you of such cancellation.

iii. Disclaimers; Limitation of Liability

Your use of items purchased through the Website is at your sole risk. Such items are provided “as is” and “as available’ without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Jain Parties’ total liability in connection with the items purchased through the Website and these Terms of Sale will not exceed the amount you actually paid to A. Jain for such items purchased.

The limitations set forth in this section will not limit or exclude liability for personal injury or property damage directly and proximately caused by items you purchased from us through the Website or for the gross negligence, fraud or intentional misconduct of any A. Jain Parties, or for any other matters in which liability cannot be excluded or limited under applicable law.

iv. Dispute Resolution; Binding Arbitration

INSTEAD OF SUING IN COURT, YOU AGREE THAT ANY DISPUTE RELATING TO THESE TERMS OF SALE, YOUR PURCHASE OF AN ITEM THROUGH THE WEBSITE OR ITEMS PURCHASED FROM US WILL BE SUBMITTED TO CONFIDENTIAL ARBITRATION IN NEW YORK, NEW YORK.

AN ARBITRATOR CAN AWARD THE SAME DAMAGES AND RELIEF, HOWEVER, AND MUST HONOR THE SAME LIMITATIONS STATED IN THESE TERMS OF SALE AS A COURT WOULD.

THE ARBITRATOR’S AWARD SHALL BE BINDING AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

JAIN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER IN ARBITRATION ONLY IN YOUR OR THEIR RESPECTIVE INDIVIDUAL CAPACITIES AND IN SO DOING YOU WAIVE THE RIGHT TO A TRIAL BY JURY, TO ASSERT OR PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS ACTION ARBITRATION (EITHER AS A NAMED-PLAINTIFF OR CLASS MEMBER), AND TO ASSERT OR PARTICIPATE IN ANY JOINT OR CONSOLIDATED LAWSUIT OR JOINT OR CONSOLIDATED ARBITRATION OF ANY KIND.

v. Governing Law
